Proving Pain and Suffering Damages

One question we get a lot from clients is about proving non economic or pain and suffering damages.

The last person the jury wants to hear from about suffering is from our client because it appears like the person is whining.  Nobody likes a whiner. 

We like to use co workers, co sports participants, friends and family to paint a picture of how you were before vs. after the injury.  

These folks can give an anecdote to make your injury resonate with the jury.

Another way to prove pain and suffering is with the use of fitbits or apps like Strava.   These technologies help us prove your participation level in sporting activities effectively and objectively.

There are other ways to prove pain and suffering but this is a good start for those curious as to proving these difficult losses.
