Wrongful death claims are governed by Missouri Revised Statute Section 537.080. There are three classes of beneficiaries in Missouri. Class one includes the spouse, children, and parents of the person who died, who is referred to as the decedent. If there are no class one beneficiaries, then you go to class two. Class two beneficiaries are siblings of the decedent or the decedents. If there are no class three beneficiaries, then you go to class three. Class three includes anybody who can prove damages as a result of the wrongful death, who would be appointed by the court as a plaintiff ad litem.
