The Statue of Limitations on a Federal Tort Claim is two years. If you fail to file your Form 95 with the Federal Governmental Agency responsible for your injury within two years, you will be out of luck. This is a very strictly constructed statute. It even applies to minors! For example children with birth injuries really can't be evaluated to make any projections until the child is at least four years old. However, if the parents don't file the claim within two years, they will not be able to proceed.
It's better to file the claim if not sure than doing nothing at all.
