It is a big dilemma when one of my injury or malpractice clients in the St. Louis, Missouri area needs some type of care that is not covered by insurance. Ethically personal injury lawyers cannot pay for a client's medical care. There are resources to use but these resources are expensive.
Medical funding companies are set up to pay clients medical or other non insurance covered bills on a non recourse basis. This means that if you don't win your case, you are not responsible for the bills. There is a cost for these non recourse loans.
The payback rate can be double or triple. If you or your lawyer consider using one of these companies, you must find out the rate of return the companies are demanding or make sure that these terms are negotiable on the back end when the loan must be repaid.
On some types of cases, small cases, these companies make no sense. Before using one of these companies, make sure that you know whether the case is large enough and whether there is enough insurance to pay for your out of pocket expenses.
